Accused of incest, Olivier Duhamel investigated for “rape and sexual assault”

The Paris Public Prosecutors Office opened an investigation on Tuesday after the accusations of Camille Kouchner, who denounces in a book the incestuous attacks that his father-in-law, political scientist Olivier Duhamel, allegedly imposed on his twin brother when he was a teenager in the late 1980s.

The investigation was opened for rape and sexual assault by person with authority over 15 years of age, said in a statement the public prosecutor of Paris Rémy Heitz.

In a book to be published Thursday, La Familia grande (Ed. Seuil), Camille Kouchner says that his twin brother, Victor, revealed to him, when they were 14 years old, suffered touching from their father-in-law, renowned political scientist, former MEP and columnist in several media outlets.

According to her, the assaults would have lasted one year or years. Two or three. I dont know, wrote in this 200-page autobiographical narrative the daughter of former minister Bernard Kouchner and law professor Evelyne Pisier (who died in 2017), who had remarried Olivier Duhamel.

In 2011, a previous procedure on these facts had already been initiated, Mr. Heitz said.

According to Camille Kouchners account, his brother was then heard by the investigators. After telling them in detail of the sexual assaults allegedly imposed on him by his father-in-law, Victor refused to file a complaint. No. I do not wish to file a complaint. This story does not look at you, he told the investigators, according to his sister.

This investigation was closed without further action, the Paris prosecutor said, without giving the reasons for the abandonment of the proceedings.

At the time, already, the facts seemed prescribed.

At the time when the assaults Victor claimed to have suffered in the late 1980s, the law provided that a minor victim could file a complaint of rape by ascendant for ten years from the age of majority. Two laws have since extended this limitation period to 20 years in 2004 and 30 years in 2018, but they are not applicable to the facts already prescribed.

In the case of Victor, it is possible that the facts were prescribed in his 28th year, in 2003, according to lawyers.

The new investigation opened Tuesday, entrusted to the Brigade for the Protection of Minors (BPM), will focus on shedding light on these facts, identifying any other potential victims and verifying the possible prescription of the public action, added the prosecutor. Prescription seems likely again.
